What Is an EB-5 Visa?
The EB-5 visa program allows foreign investors to obtain a U.S. investment green card for themselves and their families by making a qualifying investment that creates jobs for American workers. Introduced by Congress in 1990, the program is designed to stimulate economic growth while providing a path to permanent residency for eligible applicants.
EB-5 Visa Requirements
To qualify for an EB-5 visa, you must:
- Make a qualifying investment:
- $800,000 in a Targeted Employment Area (TEA) – rural or high-unemployment regions.
- $1,050,000 outside of TEAs.
- Create jobs: Your investment must create and sustain at least 10 full-time positions for U.S. workers for at least two years.
- Provide documentation of lawful funds: You’ll need to show that your investment capital has been legally sourced.
The EB-5 Visa Process
The EB-5 visa processing time varies but typically includes the following steps:
- File Form I-526E: Submit your investment details and prove you meet the program’s requirements.
- Receive conditional permanent residency: Once approved, you and your family can live and work in the U.S. for two years.
- File Form I-829: Remove conditions on your green card by proving job creation and compliance with program guidelines.
Each step is intricate and time-sensitive, making the support of experienced EB-5 visa lawyers essential.
