What is a Domestic Violence Protective Order (DVPO)?

A domestic violence protective order (DVPO), sometimes called a 50B order, is a legal tool designed to protect individuals from domestic abuse. If you have been the victim of domestic violence by someone with whom you have a “personal relationship” (such as a spouse, ex-spouse, or someone you live with), a DVPO may be your best option for securing immediate relief and protection.

Who Can File for a Domestic Violence Protective Order?

In North Carolina, a domestic violence protective order can be filed if the victim is in one of the following relationships with the offender:

  • Current or former spouses
  • Persons who live together or have lived together
  • Parents and children (including grandparents and grandchildren)
  • Individuals who have a child in common
  • Current or former household members
  • People in a dating relationship or who have been in a dating relationship

What Protections Does a DVPO Provide?

A domestic violence protective order can provide several forms of protection, including:

  • Ordering the abuser to stop contacting or approaching you
  • Requiring the abuser to move out of your home or residence
  • Prohibiting the abuser from visiting your workplace or school
  • Granting temporary custody of children
  • Ordering the abuser to pay child support, if applicable

If you’re in immediate danger, a DVPO can be granted quickly and can last for up to one year.

What is a Civil No-Contact Order (50C)?

If you have experienced sexual assault or stalking by someone with whom you do not have a “personal relationship,” a civil no-contact order (also called a 50C order) may be the right option for you. A 50C order can provide significant protection against someone who is stalking or harassing you, but does not fall under the DVPO category due to the lack of a personal relationship.

Who is Eligible for a Civil No-Contact Order (50C)?

To qualify for a civil no-contact order (50C), you must meet these criteria:

  1. No Personal Relationship: You must not have a personal relationship with the offender (i.e., not a spouse, cohabitant, family member, or dating partner).
  2. Unlawful Conduct: The offender’s actions must include unlawful conduct, such as sexual assault or stalking. This includes harassment, following you, or causing you emotional distress through repeated unwanted contact.

What Protections Does a Civil No-Contact Order Provide?

A 50C order can include protections such as:

  • No contact with you by any means (telephone, email, social media, etc.)
  • No harassment or stalking, including at work or school
  • No approaching or visiting your home or other designated locations
  • Ceasing any actions that cause you emotional distress or fear

A civil no-contact order can last up to one year, depending on the judge’s decision.

How Long Does a Protection Order Last in North Carolina?

Whether you are seeking a domestic violence protective order or a civil no-contact order, the duration of the protection is crucial. Typically, both orders are granted for one year. However, if circumstances change, you can ask the court to renew the order before it expires, keeping your protections in place as needed.

Violating a No-Contact Order in NC: What Are the Consequences?

A no-contact order in North Carolina is a serious legal matter. If the offender violates the terms of the no-contact order, such as by contacting or approaching you, there are legal consequences. Violating a no-contact order in NC can result in:

  • Criminal charges: Charges such as harassment, stalking, or communicating threats may be filed.
  • Contempt of court: You can return to court to request that the judge hold the offender in contempt for not obeying the order.
  • Escalating penalties: If the offender continues to violate the order, the offense may be upgraded from a misdemeanor to a felony.
